While the prosecutor, in this case, requested 2 months detention for living in Switzerland as a sans-papiers, we asked for a complete acquittal, as well as 200 CHF compensation for the day he already had to spend in detention…

👩‍⚖️👨‍⚖️ Furthermore, the ruling is important because it serves to remind the authorities that imposing a detention sanction for illegal stay is often unlawful, just as unlawful as imposing a financial penalty. 💸

🏳️‍🌈🌈One last reason why this win is meaningful – being a member of the LGBTQ community, our client belongs to a vulnerable group that is exposed to additional risks, like violence and discrimination based on their sexual orientation and gender identity!!
